ACEOs, Copyrights, and Questions

Journal Entry: Fri Feb 15, 2008, 4:19 PM

Well I have to say I have definintely been smitten by the ACEO bug. Does anyone know how or what to use for backing on an ACEO? Is it a necessary? I haven't been putting any kind of backing on mine, afraid it might hurt the artwork. I can see maybe a print but not an original.

Also, a recent customer of mine said I should try drawing Harry Potter ACEOs, says they are really selling fast and hot on ebay. Aren't there copyright issues on drawing HP and selling it? I mean I would hate to have JK Rowling sue me over copyright issues.

Hi Carol!! You are very smart wondering about the copyright issues over HP. Yes, you would be breaking copyright by making them & especially by selling them. As you can see, many people don't care or don't know (but I suspect it's more don't care). Nonetheless, it is illegal to copy HP pictures.

As for backing for an ACEO. Generally a backing is not necessary, depending on the type of support you use. If I use vellum film, I have to put a backing on it because of it's fragility but also because the film is semi-tranparent and I use the backing to add color to the whole painting as well as for support to the film (I do NOT attach the backing to the ACEO, I just lay the ACEO on top of it). For all my other ACEOs I do not use any backing.

Welcome to the ACEO nuts group!!! They are addictive aren't they!!

PS: I'm going to note you about a new Arts & Crafts Auction site!!!!

When I sell my aceos, I don't exactly "back" them -- but do pretty much the same thing as ElwynEllessar. I slip it into the film/pouch over either a basic cardboard mount. If I'm looking to dress it up, I use heavy posterboard or cardstock in various colours. Typically, I keep the colours very simple -- but I have done some wilder "mounts" with jewel tones for some of my middle eastern designs.

For the most part, so long as you have something sturdy behind it in the film or pouch to keep it from getting a fold, bend, crease or other unhappy accident, it should be fine. :) (I'd also like to note that when I just buy basic heavy posterboard or cardstock, I still have had MANY compliments to the care in my packing and shipping my originals.)

ACEOs are evil... they make me take extended breaks from larger pieces. There's nothing like the "instant gratification" of having a piece finished in a day! *grins*

About those copyrights, I don't think you will be breaking any copyrights. As long as you credit the rightful owner of the characters. There are so many professional artists who have been drawing HP, and I never heard that they have been sued . Really, never. I think that's called fanart, and as long as you credit everyone properly, I don't think there should be a problem. But you could ask someone who knows a lot about laws and copyrights, just to make sure :)

Thanks for the input! So if you do fanart, authors or actors can't sue? I think most of the artists who draw HP, don't sell their works or do they? Most draw or paint Harry just because they like the character.
I would assume copyrights would mean either crediting JK, Warner Bros and/or the actor, Daniel Radcliffe. I am wondering, if I would have to get permission from them, before I sell to the customer or on ebay. So much to consider. I have heard of actors suing artists, for painting or drawing them without permission.

Thanks Nancy! That is what I thought it would be a copyright infringement, if you tried to sell any HP art, especially on ebay. I was real surprised, when the customer asked me about HP and drawing him to sell to her or on ebay. So I did an ebay search and didn't find any ACEOs of Harry. But I did find some HP artwork from some artists that were selling on ebay.
Thanks so much for the input on the backing. I just wanted to make sure I was doing those right.

Thanks Nora for the info! I appreciate it very much. I have been just putting the ACEOs into a protective sleeve/clear plastic bag and then into a thick cardboard USPS package. I think adding the cardstock or posterboard is a good idea, for that added protection.
Yes, I agree wholeheartedly, I am so slow at drawing larger pieces, it can take me up to 2weeks or longer. I get so excited when I finish an ACEO in about 2 days.
BTW, I got your message in my guestbook. Thanks so much! I would love to exchange links with you. Just note me your site info.

Hmm, you're right, I don't know if those artists actually sell their HP drawings. So I looked few things up on the net;
and I found out that this is a very complicated thing. As you can read it here on Wikipedia [link]
On this forum, I think there are some good tips about HP fanart: [link]

I hope this will help you a bit!
